By this Petition, the Petitioner is challenging the order passed by the 7th Family Court, Mumbai dated 22.08.2023, below Exhibit 10A, firstly for enhancement of the maintenance amount granted by Digitally signed by RAJESHRI PRAKASH AHER Date:
2025.06.20 19:03:06 +0530 the Court; and secondly on the ground that maintenance had been RAJESHRI PRAKASH AHER granted from the date of passing of the order and not from the date of filing of the application.
So far as the second ground is concerned, it is now no more resintegra that the maintenance has to be granted from the date of the application.
So far as the quantum of maintenance is concerned, the learned Rajeshri Aher
2/2 7 wp 3828 of 2024.doc advocate for the Respondent submits that Respondent has been paying the maintenance amount regularly, however, she wants to produce certain documents in support of the contention that Respondent has cleared the maintenance dues. This position is denied by the learned advocate for the Petitioner contending that after the order was passed by this Court on 12.07.2024, cheque for an amount of Rs.6,00,000/-, was handed over to the Petitioner, which was initially bounced, however, thereafter she has received the said cheque amount, but after the said amount, the Respondent has not paid regular maintenance amount, as directed by the 7th Family Court, Mumbai.
The learned advocate for the Respondent seeks accommodation to place on record the documents in support of her contention that Respondent-husband is regularly paying the maintenance amount to the Petitioner. At the request of learned advocate for the Respondent, stand over to 24.06.2025.
