Learned counsel for the petitioner has a grievance that the respondent is in arrears towards payment of maintenance. There is dispute regarding interpretation of the operative part of the order granting maintenance.

However, learned counsel for the respondent submits that the respondent is agreeable to pay certain ad-hoc amount towards arrears of maintenance without prejudice to the rights and contentions of the parties.

Learned counsel for the respondent has handed over a

cheque for an amount of Rs. 6 Lakhs in favour of the petitioner. 4.

Learned counsel for the petitioner has accepted the cheque without prejudice to the rights and contentions of the petitioner regarding interpretation of the operative part of the impugned order. 5.

Learned counsels for the parties further submit that the parties are agreeable to explore possibility of an amicable settlement. They request that the parties be referred for mediation. 6.

By consent, Smt. Anuja Prabhudessai (Retired) is appointed as a Mediator.

The respondent shall bear the charges towards the mediation, if any.

Learned Mediator is at liberty to issue necessary directions regarding payment of mediation charges, if any. 9.

Learned counsel for the petitioner to intimate this order to the learned Mediator and submit necessary papers. Learned counsel for the petitioner also to intimate this order to the main Mediation Centre, High Court Bombay.

Learned counsel for the respondent further submits that the respondent shall continue to pay the monthly maintenance and also make arrangements for clearing the arrears towards maintenance.

It is clarified that the payment of arrears towards maintenance during the pendency of the mediation shall be without prejudice to the rights and contentions of the parties.

List the petition under the caption "for settlement" on 12th September 2024.
