Both the learned Counsels for the respective parties submit that the Writ Petition be disposed of with directions to the learned Trial Court to dispose of the suit as early as possible and within a time bound manner.

It is submitted that the temporary injunction application filed by the respondent was rejected vide order dated 10.08.2020. The said order was taken up in challenge by the present respondent in the Miscellaneous Civil Appeal No.21 of 2020, which came to be allowed by the learned District Judge2, Shrigonda vide order dated 26.02.2024. As against this, the present petition is filed by the original defendant.

It is a matter of record that there is no interim relief staying execution and operation of the order passed by the learned District Court. It is submitted that the matter has already reached the stage of evidence, and the parties are ready to lead their respective evidence and to conclude the trial.

In view of this, I deem it appropriate to dispose of the Writ Petition in terms of the oral request made by both the learned Counsels for the respective parties.

The learned Trial Court is requested to hear the parties and to conclude the trial within a period of 12 months from today.

Both the learned Counsels undertake not to take unnecessary adjournments and not to protract the litigation. 7.
Writ Petition is disposed of accordingly.
