This Court (Coram: Amit Borkar, J) on 29th April, 2024 has passed the following order which read as under:

1. The petitioner has filed undertaking dated 5th April, 2024 to deposit 50% recoverable dues as required under Section 154(2)(A) of the Maharashtra Cooperative Societies Act, 1960. Undertaking is Shantanu Dhudum 1/2

2. Hence, issue notice to respondent No.1, returnable on 18 June 2024.

3. It is made clear that, if the petitioner fails to abide undertaking, the writ petition shall stand dismissed without further reference to the Court.

4. In view of the said undertaking, till next date, there shall be ad-interim relief in terms of prayer clause (d). 2.

Undisputedly, the 50% recoverable dues has not been deposited. On the failure of the petitioner to abide the undertaking the petition stood dismissed without further reference to the Court. 3.

In view of the above, the petition formally stands dismissed.
