This petition under Article 226 of the Constitution of India is filed praying for a relief that the suit in question which is of the year 1990 (Old Number regular Civil Suit No.2311 of 1990) and renumbered as Special Civil Suit No.33 of 2018 be taken up for adjudication as expeditiously as possible. It is contended by the petitioner that it is almost 35 years that the suit is pending and being one of oldest suit ought to have been given priority in adjudicating. From the perusal of the record, we find ourselves in agreement with the petitioner that there ought not to be any further delay, there are also specific directions which are issued by the High Court in relation to the suits which are more than 30 years old, which ought to have 22 April 2025 Kiran Kawre

We accordingly direct the learned Civil Judge Senior Division, Pune to proceed with the suit on day to day basis and decide the suit within a period of six months from today. All contentions of the parties on the proceedings are expressly kept open.
