This petition has been filed by the opponent in section 24 of the Maharashtra Rent Control Act, 1999, of the application filed, before the Competent Authority, Konkan Division. 3.

It is the case of the petitioner that though there was an

KVM 2/2 504 - WP 4400 OF 2024.doc leave and licence agreement, the parties have agreed by way of an MOU for sale of the suit flat. Learned counsel for the petitioner submits that a sum of Rs.3,00,000/- by way of a cheque has been paid one year before the alleged leave and licence agreement entered into.

The matter has been moved on the ground that there is an urgency. The possession of the suit flat is likely to be taken away by as the order has been passed by the Competent Authority for possession today.

Stand over to 18 June, 2024.

In the meanwhile, no coercive action should be taken against the petitioner.
