CORAM : M.S. Sonak & Jitendra Jain, JJ.

DATED : 09 APRIL 2025 PC:- 1.

The above Petitions are not on board. They were on board yesterday but could not reach.

2.

Mr Choudhari, the learned Counsel for the Petitioners mentions these matters and states that the issues involved are identical to the issues involved in Writ Petition No. 9170 of 2023, which we have just disposed of.

3.

Accordingly, with the consent of the learned counsel for the parties, these Petitions are taken on board for disposal. 4.

Mr Choudhari, on instructions states that the Petitioners in this case have received the entire compensation payable to them. However, this compensation was paid after considerable delay and the interest for this delay has not been paid. 5.

Learned Counsel for the Respondents submits the delay was not attributable to them and therefore, no interest may be payable.

6.

By adopting the reasoning in our order disposing of Writ Petition No. 9170 of 2023, we permit the Petitioners in these Petitions to make a representation to the competent authority within two weeks from today, giving full particulars, case law etc. The competent authority must hear the Petitioners and dispose of these representations by passing a speaking order within three months of receiving the representation.

7.

If the competent authority determines that interest is payable, then the same should be paid within a month of such determination.

8.

If the competent authority makes any adverse order, then the Petitioners will have the liberty to challenge the same in accordance with law.

9.

All contentions of all parties on this interest issue are left open.

10.

These Petitions are disposed of in the above terms without any costs order. All concerned to act on an authenticated copy of this order.
