Learned Counsel for the Petitioner states that the Petitioner, for the present will be satisfied if the directions are issued to the Collector of Pune District (R-3) to consider and dispose of the Petitioner's representation dated 18th September 2023 (Exh.G at page 37).

Accordingly we direct the 3rd Respondent to consider and dispose of the Petitioner's representation dated 18th September 24th June 2024
43-ASWP-4729-2024.DOC 2023 in accordance with law and on its own merits. The Collector must hear the Petitioner and the Gram Panchayat, Nande(R-7) and pass a reasoned order on the Petitioner's representation. This exercise would be completed by 5th August 2024. The decision would be communicated to the Petitioner and the 7th Respondent by 14th August 2024.

We clarify that we have not examined the rival contentions and therefore, it is open to the 3rd Respondent to decide the issue raised in the Petitioner's representation.

The Petition is disposed of with the above direction. There should be no order as to costs.
