IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 4773 OF 2024 LAXMAN NAGNATH AALGULE

VERSUS

SULOCHANABAI W/O PANDHARINATH KOTWAD AND OTHER ...

Advocate for the Petitioner : Mr. Shirrurkar Kishor T., Advocate for Respondent No.1 : Mr. V.S. Undre ...

CORAM

: ABASAHEB D. SHINDE, J.

DATE : 20.02.2026 PER COURT:

1.

Heard the learned counsel for petitioner and learned counsel for respondent No.1. The petitioner is taking exception to the concurrent finding of facts recorded by the trial court in the first place, thereby, granting temporary injunction in favour of the respondents/plaintiffs and confirmed by the District Court. 2.

I have gone through the findings recorded by both the Courts below and I do not find any reason to interfere with the said concurrent finding of facts, however, considering the fact that the suit is of the year 2020, the learned Joint Civil Judge, Junior Division, Ahmedpur, is requested to decide the Regular Civil Suit No.417/2020, as expeditiously as possible, and preferably within a period of one year from today. The writ petition thus stands disposed of.
