This is a motion for speaking to the minutes of the order dated 08.05.2024. It is pointed out that in paragraph 5, the direction to file the affidavit has been inadvertently not typed, which is found in all other orders passed by this Court. The learned advocate for the Respondents confirms the said statement.

In view of the above, paragraph 5 of the order dated 08.05.2024, shall read as under:

In view of the above, the Petitioner would be permitted to discharge his duties until further orders. He would not be entitled for any salary or monetary benefits, and to that effect, Petitioner would tender his affidavit undertaking in this Court and submit a copy to his employer, on or before 15.08.2024. 3.

Issue notice to the Respondents, returnable on 02nd July, 2024. The learned AGP waives service of notice on behalf of Respondent No.1/State.

Since the Government Resolution, dated 20.02.2024 is sought to be quashed and set aside, issue notice to the learned Advocate General of the State of Maharashtra. The learned AGP accepts service of notice on behalf of the learned Advocate General.

The Petitioner would be superannuating on 31.05.2024. The learned Advocate for the Petitioner cites an order dated 30.04.2024, passed by this Court in Writ Petition No. 2539/2024 (Mahavirsing Ramcharan Chauhan and Others Vs. The State of Maharashtra and Anr) and submits that the same directions can be issued. Similar directions were issued by the Nagpur Bench.

In view of the above, the Petitioner would be permitted to discharge his duties until further orders. He would not be entitled for any salary or monetary benefits, and to that effect, Petitioner would tender his affidavit undertakings in this Court and submit a copy to his employer, on or before 15.08.2024.

All office objections to be removed on or before 24.06.2024, failing which, this Petition would stand dismissed without further reference to the Court, on 25.06.2024.
