The matter in hand entails consideration of an order dated March 13, 2024 passed by the Collector, Pune suspending the Wine Shop run by the Petitioner. The allegation against the Petitioner is that when the electoral code of conduct was in place, vehicles were found ferrying alcohol in the neighbourhood and the driver of the vehicle attributed the activity to the Petitioner.

The suspension was stayed on the next morning by the Commissioner of State Excise, Maharashtra hearing an appeal against November 18 2025 Shraddha

11-WP-4956-2024 .doc such suspension. A week later, the Commissioner lifted the stay and confirmed the temporary suspension order by an order dated March 22, 2024. A Learned Single Judge of this Court has stayed the order dated March 22, 2024 by an order dated April 1, 2024. 3.

Till date, there is no update about what has transpired pursuant to the findings originally rendered, which led to the temporary suspension. A suspension of the business ought to be in aid of the proceedings to be initiated for the inflections identified. We are now in November 2025 and it would be important to ascertain what activity has been undertaken in connection with the alleged violation over the last one and half years.

To enable the Learned AGP to take instructions, stand over to November 25, 2025.
