DATE : 4 APRIL, 2024 P.C. :- This is a petition filed by the husband challenging the interim maintenance amount granted by the Family Court, Nashik at the rate of Rs.9,000/- per month from 27 July, 2021. 2.
In order to show his bona fide, the petitioner is directed to deposit a sum of Rs.1,35,000/- within a period of two weeks from today before the Family Court at Nashik. 3.
Subject to the petitioner depositing a sum of Rs.1,35,000/-
2/3 issue notice to the respondent, returnable on 2 May, 2024. 4.
Apart from the court notice, the petitioner is also permitted to serve the respondent by private service, by all permissible modes of service and file affidavit of service before the next date of the hearing.

Without prejudice to the rights and contentions of both the parties, the petitioner thereafter to continue to deposit in each succeeding month, the interim maintenance as directed by the impugned order till further orders.

Subject to the petitioner depositing a sum of Rs.1,35,000/-, there will be ad-interim relief in terms of prayer clause (b) of the petition till the next date of the hearing. The said prayer clause (b) reads as under :- (b) Pending the hearing and final disposal of the present Civil Revision Application, this Hon'ble Court may further be pleased to stay the effect, operation, implementation and execution of the impugned order
3/3 dated 26.9.2023 passed by the Learned Family Court, at Nashik below Exh. 5 in Petition No. A-447 of 2021, on such terms and condition, as this Hon'ble Court may deems fit and proper.

If the petitioner fails to comply with the directions given above, the protection granted by this Court will automatically stands vacated.
