This Writ Petition is filed by the original Defendants. It is the case of the Petitioners that there is leakage in the suit premises. Above the suit premises is the terrace of the landlord. He submits that urgent water proofing has to be done. The application of water proofing of the terrace was rejected by the Appellate Bench of the Court of Small Causes. Mumbai. Hence the present Writ Petition.
