This is yet one more example of a litigant having being compelled to unnecessarily filing a Writ Petition only because the Education Officer (Secondary), Raigad Zilla Parishad, is not deciding the application dated 18th October, 2023 vide which, the Management has pointed out the applicability of the Maharashtra Civil Services (Declaration of Small Family) Rules, 2005 (the said Rules) which were introduced on 28th March, 2005.

We could have initiated a disciplinary action against the Education Officer in view of Section 10 of the Maharashtra Government Servants Regulation of Transfers and Prevention of Delay in Discharge of Official Duties Act, 2005 (the said Act). The learned AGP submits that leniency may be shown. Hence, we are imposing cost of Rs. 5,000/- on the Education Officer which he shall deposit in this Court within a period of 30 days from today. 3.
We record the consent of the Petitioner that the said amount be donated to a public cause. In view of the said statement, the Registry shall transfer the said amount to the following establishment:

This Petition is disposed off with a direction to Respondent No.4 to consider the application dated 18th October, 2023 along with the relevant file pertaining to Mrs. Manisha Anil Dhumne, Junior Clerk, Shri. Sanjay Ram Khade, Chief Clerk and
Mrs. Sunita Sanjay Khade, Deputy Head Mistress, within the provisions of the said Rules referred to herein above, within 45 days from today.
