This Writ Petition has been filed by the husband challenging the interim maintenance order dated 16 October 2023 passed by the Family Court, Nashik below Exhibit - 16. By the impugned order, the Family Court, Nashik directed the husband to pay Rs.10,000/- per month to the wife and Rs.4,000/- per month to his son, from the date of the application i.e. 3 March 2022 till the disposal of the Writ Petition. Mr.Gite appearing for the Petitioner (husband) submits that the salary of 1/3
the Petitioner as of now is roughly around Rs.1,40,000/- per month. As per the impugned order, the outstanding amount as of now is roughly around Rs.3,08,000/-.

In order to show his bona-fide, the Petitioner to deposit a sum of Rs.3,08,000/- before the Family Court, Nashik within a period of three weeks from today. Subject to the deposit of the outstanding amount before the Family Court, Nashik, issue notice to the Respondent returnable on 3 May 2024. 3.
Apart from the Court notice, the Petitioner is permitted to serve advocate's private notice by all permissible modes of service and file affidavit of service before the returnable date.

Subject to the Petitioner depositing the outstanding amount before the Family Court, Nashik, there will be ad-interim relief in terms of prayer clause (c) till the next date of hearing. Prayer clause (c) of the Writ Petition reads as under :- "(c).
Pending the hearing and final disposal of the present petition be pleased to stay the execution, operation and implementation, of impugned judgment and order dated 16 October 2023 passed by Ld. Family Court at 2/3
Nashik below Exh-16 in Hindu Marriage Petition No.A 56 of 2021".

Mr.Gite seeks liberty to enclose a copy of the Petition No.A-56 of 2021 to the Writ Petition. Liberty as prayed for is granted. The amendment to be carried out forthwith. (RAJESH S. PATIL, J.) 3/3
