Learned counsels for the parties submit that the Mediator initially appointed has expressed her inability to act as Mediator. Learned counsel for the parties therefore request that some other Mediator be appointed.

Learned counsel for the petitioner submits that Mr. S. G. Deshmukh, Advocate practicing in this Court has agreed to mediate. 3.

Learned counsel for the respondent has no objection to appoint him as Mediator.

By consent, Mr. S. G. Deshmukh, Advocate practicing in this Court is appointed as Mediator.

Learned counsel for the petitioner submits that mediation charges, if any, will be paid by the petitioner. Learned Mediator is at liberty to issue necessary directions regarding payment of mediation charges, if any.

Learned counsel for the respondent has tendered an affidavit dated 29th August 2024 which according to the respondent, is in compliance with the directions issued in paragraph no. 7 of order dated 16th July 2024. Though I do not find that this is in compliance with the directions issued, I am not inclined to record any observations on the same as the learned counsel for the petitioner submits that the petitioner to show his bonafides is already paying the amount towards maintenance as directed by the impugned order. Hence, the issue with regard to statement made on behalf of respondent in the affidavit will be dealt with, if at all the petition is required to be heard on merits. 7.

List the petition under the caption for 'Settlement' on 13th November 2024.
