This petition was circulated on behalf of the respondent-father as the respondent was unable to meet the child in respect of the orders passed by the Family Court for access.

Both the parties have their own versions regarding availing access at the place where the orders passed by the Family Court permitting the respondent to avail access.

At this stage, I do not intend to examine the rival versions by IRESH MASHAL Date:

expressed by both the parties.

Considering the age of the child and the nature of dispute between the parties, this Court suggested that let the child spend some time with the father at his own house. After certain deliberations, the petitioner who is present in the Court, agrees that custody of the child will be handed over to the respondent for availing access on this Saturday i.e. on 19th October 2024. The petitioner submits that she will hand over the child to the respondent at the entry gate of her residential building at Andheri at 11.00 a.m. She agrees that the child can spend time with the respondent the entire day at his house. 5.
Respondent agrees that he shall bring back the child latest by 7.30 p.m. on the same day and hand over the custody to the petitioner at the same place.

The aforesaid assurances given by both the parties are accepted as an undertaking to this Court. It is clarified that if the assurances are not abided by the parties, appropriate directions will be issued on the next date.

List the petition for compliance on 21st October 2024. To be listed under the caption for 'directions'.

In the meantime, parties are at liberty to exchange their offers for an amicable settlement.
