The Petitioners have been appointed on the establishment of the Municipal Corporation under the Reproductive & Child Health (RCH-II) Program on a contractual basis and they are now seeking directions against the Respondent No. 2 to absorb, regularize and confer permanency benefits on them from the date of their entry into service, along with consequential benefits, including the deemed date of permanency.

Respondent No. 2 - Municipal Corporation has filed an affidavit-in-reply contending that the Petitioners were appointed on
2 930WP5725.2024.odt a contractual basis, as per the terms and conditions mentioned in the appointment order.

However, Mr. Barde, learned Advocate appearing for the Petitioners, points out that in many other Municipal Corporations, similarly situated employees have been conferred the benefit of permanency and regularization. 4.
It is the contention of Respondent - Municipal Corporation that, a proposal to consider the Petitioners' claim for absorption, as per the staffing pattern, has been moved to the Principal Secretary, Urban Development Department, Government of Maharashtra, vide communication dated 19.12.2023, and till today, no decision has been taken by the State. 5.
In light of the above, we deem it proper to dispose off the Writ Petition by issuing directions to the Respondent No. 1 to decide the Proposal dated 19.12.2023 within a period of three (3) months from today.

The learned AGP to communicate this order to the Respondents.
