The respondent-husband ('respondent') is present in the Court. Since the petitioner-wife ('petitioner') is unwell, her sister with Page no. 1 of 3
whom the petitioner is residing is present in the Court. Both parties agreed that the dispute could be sorted out if they were referred for mediation. I am informed that pursuant to the last order dated 28th June 2024, the respondent had met the petitioner and their minor daughter. According to both parties, the meeting was smooth and without any untoward incident.

Learned counsel for the petitioner makes a grievance that the respondent is in arrears of maintenance amount to the tune of Rs. 13,83,000/-. Learned counsel for the respondent submits that he will verify with regard to the payment already made and the arrears amount. However, he on instructions of the respondent who is present in the court submits that the respondent will pay an amount of Rs. 5,00,000/- towards maintenance to the petitioner by transferring the amount to her bank account latest by 8th July 2024. The statement made on behalf of the respondent is accepted as an undertaking to this Court. Learned counsel for the respondent states that the respondent would make an attempt to clear all the remaining arrears latest by four weeks from today. 3.
By consent of the parties Justice Anuja Prabhudesai (retired) is appointed as Mediator. Learned counsel for the petitioner shall intimate this order to the learned Mediator, alongwith necessary papers. Learned counsel for the petitioner shall also intimate this Page no. 2 of 3
order to the main Mediation Centre, High Court, Mumbai. 4.
The respondent shall bear the charges towards mediation. The learned Mediator is at liberty to issue necessary directions regarding the payment of charges, towards mediation. 5.
Learned counsel for the petitioner has expressed certain apprehensions with regard to a conversation of the respondent with the minor daughter. Learned counsel for the respondent on the instructions of the respondent submits that whenever he meets the minor daughter he will discuss only about her education and her well-being and will not discuss about pending litigations and about any family disputes. Learned counsel for the petitioner submits that the petitioner or her family members have no objection if the respondent contacts the minor daughter or meets her whenever possible.

In view of the aforesaid order, till the next date no coercive action to be taken against the respondent for recovery of arrears of maintenance amount and in the pending proceedings between the parties, the parties shall make an application for adjournment. (GAURI GODSE, J.) Page no. 3 of 3
