IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 5733 OF 2024 Dipika Ravi Soni .....Petitioner Vs.

Ravi Ghanshyamlal Soni .....Respondent WITH WRIT PETITION NO. 4784 OF 2024 WITH INTERIM APPLICATION NO. 7208 OF 2024 IN WRIT PETITION NO. 5733 OF 2024 Ravi Ghanshyamlal Soni .....Petitioner Vs.

Dipika Ravi Soni ....Respondent Ms. Ghazala Z. Khan for the petitioner in WP 5733/2024 and for respondent in WP 4784/2024 Mr. Priyank Daga for respondent in WP 5733/2024 and for petitioner in WP 5733/2024 CORAM : GAURI GODSE, J.

DATE :

7th AUGUST 2024 ORDER:

1.

I am informed that mediation meetings are still going on. By order dated 3rd July 2024, respondent had made a statement that he 1/3

would clear all the arrears within four weeks. However, learned counsel for the petitioner submits that respondent is still in arrears around Rs. 6,55,000/-. She further also has grievance that though agreed, respondent has refused to clear the medical expenses. She submits that since the petitioner has no independent source of income and her medical condition requires huge expenses, respondent be directed to clear the arrears.

2.

Learned counsel for the respondent disputes the amount of arrears, however, he submits that he would take necessary instructions regarding the exact arrears towards maintenance and intimate the respondent to clear the arrears. 3.

Learned counsel for the respondent is at liberty to intimate the calculations regarding the payment of amount and his statement regarding arrears to the learned counsel for the petitioner. 4.

Learned counsel for the respondent further submits that if there are any medical bills to be cleared or reimbursed to the petitioner which she has already incurred, the petitioner be directed to hand over the bills to the learned counsel for respondent. He submits that he would forward the same to the respondent.

2/3

5.

Since the parties are in the process of an amicable settlement and considering the medical condition of the petitioner, it is expected that respondent cooperates in clearing medical expenses and also pays the arrears towards the maintenance.

6.

List the petition under the caption "For Settlement" on 27th August 2024.

7.

It is clarified that since the parties are making an endeavour to settle the dispute amicably and considering the statement made on behalf of respondent to clear the arrears towards maintenance, no coercive action to be taken for recovering the amount of maintenance as per the impugned order.
