This Writ Petition is filed challenging the order dated 22 January 2024 passed by the Civil Judge (Senior Division), Belapur.

On the instructions of his client, Mr.Hande appearing for the Petitioner submits that as regards item No.(2) of the operative part, his client is ready and willing to comply with the same. As regards item No.(3) of the operative part, his client has already paid a sum of Rs.9,65,000/- to the Plaintiff after 1/3

passing of the impugned order. As regards the balance amount of Rs.17,65,500/-, the same will be paid within a period of three weeks from today.

The submission made by Mr.Hande on behalf of his client is accepted as an undertaking given to this Court by the Petitioner.

Issue notice to the Respondent, returnable on 18 June 2024. Apart from the Court notice, the Petitioner is permitted to serve the Respondent by advocate's private notice by all permissible modes of service and file affidavit of service before the returnable date.

In the meanwhile, there will be ad-interim relief in terms of prayer clause (f) till the next date of hearing. Prayer clause (f) of the Writ Petition reads as under :- "(f).

Pending the hearing and final disposal of the present Writ Petition, the Special Civil Suit No.1481 of 2023 pending before the Ld. Civil Judge Senior Division Belapur may kindly be stayed."

Mr.Hande seeks liberty to add new prayer. Liberty as prayed for is granted. The amendment to be carried out 2/3

forthwith.
