On 18th July 2024, the following order was passed :- 1.
The petitioner has sought limited relief by way of a direction to the 2nd respondent to decide the application made by the petitioner dated 2nd November 2023 seeking change of user of the land under the provisions of Section 42-B of the Maharashtra Land Revenue Code, 1966, which application has been kept pending for the opinion of the respondent-State of Maharashtra in relation to the FIR that was to be lodged for obtaining forged ULC Certificate. Such opinion has been sought by the Collector, Pune from the Principal Secretary, Urban Development Department on 29th December 2023.

Considering the fact that a limited relief is sought in the present petition and that the aforesaid issue had already been dealt 1/2
509-WP-5816-24.doc Rameshwar Dilwale with by this Court vide order dated 31st July 2023 passed in Writ Petition No. 1268 of 2019, the writ petition is adjourned for a period of six weeks by directing the 2nd respondent to express its opinion on the query made by the respondent no.3 on 29th December 2023 within a period of six weeks from today. No costs. 3.
Though the period of six weeks has elapsed, there is nothing heard from the respondent no.2. Only by way of indulgence, time is extended till 20/09/2024 to express an opinion as referred to earlier. An affidavit shall be filed in that regard failing which it would be treated that the direction issued on 18th July 2024 has not been complied with.
