The contention of learned counsel appearing for the Petitioner is that the notice was not served on the Petitioner and therefore he has not been heard before passing the impugned order. He would further submit that the objection is on the ground that the land has already been conveyed to the society in the year 1998 and thus the proceedings could not have been instituted under Section 11 of MOFA. 3.

Issue notice to the Respondents, returnable on 15th January 2025. In addition to Court notice, learned counsel appearing for the Petitioner to serve the Respondents by private notice by all possible modes of service and file affidavit of service before the next date. 4.
