1.

The issue in the present Writ Petition No. 5914 of 2024 is regarding the allotment of a plot in the MIDC, T.T.C. Industrial Area, Digitally signed by ASHWINI JANARDAN VALLAKATI Date:

2024.12.03 15:03:50 +0530 ASHWINI JANARDAN VALLAKATI

Navi Mumbai. Originally Plot No. C-549 was allotted to the Petitioner admeasuring approximately 1200 Sq.Mtrs. The Petitioner has also paid approximately a sum of Rs. 3 Crore for the allotment of the said plot. It however, transpires that after the allotment, MIDC discovers that Navi Mumbai Municipal Corporation has not only constructed toilet blocks on the said plot but there are also encroachments thereon. Therefore, the said plot could not be allotted to the Petitioner. MIDC has proposed that an alternate plot, namely, Plot No.A-792 would be allotted to the Petitioner admeasuring approximately 750 Sq.Mtrs. As far as the balance 450 Sq.Mtrs. is concerned, MIDC is in fact exploring possibilities as to where the same can be allotted to the Petitioner. 2.

Considering the stand of the MIDC, we now place the matter "for directions" on 9th January, 2025. We would request MIDC to complete this entire exercise on or before the next date and inform the Court accordingly.

3.

Stand over to 9th January, 2025.
