This matter was heard for some time. A passover was granted. 2.

We had passed an order on 25.06.2024. Pursuant thereto, the Petitioner has tendered an additional affidavit dated 05.07.2024. The learned Advocate for the Petitioner submits that since his name is already enlisted and in the light of judgment of the Full Bench of this Court in Sunita Dinesh Gaikwad and another Vs. State of Maharashtra and another, decided on 27.07.2023 (Writ Petition No. 9284 of 2022), the Petitioner has a right to seek compassionate appointment. 3.

By relying upon the communication dated 05.01.2023, addressed by the Assistant Commissioner, Municipal Council Administration, Office of the District Collector, Aurangabad addressed to the Chief Officer, Municipal Council, Khultabad- Respondent No.3

914wp6080-24 herein, the Petitioner desires to withdraw this Petition and pursue the matter in view of the directions of the Assistant Commissioner, dated 05.01.2023.
