This writ petition is filed by the landlord challenging an order passed by the Appellate Court, thereby directing the landlord to handover the keys of the suit premises to the respondent herein.

Mr.Deo, learned counsel appearing for the petitioner landlord submits that his client has informed him that the Court

2/3 Commissioner is expected to be on site for executing the order pased by the Appellate Court, on 24 April, 2024. Mr.Deo submits that hence this matter has been moved.

Issue notice to the respondent, returnable on 18 June, 2024.

Apart from the court notice, the petitioner is also permitted to serve the respondent by private service, by all permissible modes of service and file affidavit of service before the next date of the hearing.

In the meanwhile, there will be ad-interim relief in terms of prayer clause (c) till next date of the hearing. The said prayer clasue (c) reads as under :- (c) Stay the further execution, operation and implementation of the Judgment and Order dated 04/04/2024 passed by the Ld. Appellate Bench of Small Causes Court, at Mumbai in Miscellaneous Appeal No. 2 of 2024 in Order below Exhibit - 10 in

3/3 RAD Suit No. 140 of 2023 till hearing and final disposal of the aforesaid Writ Petition.
