IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 6186 OF 2024 Ashatai @ Ashabai Kakasaheb Kolte

VERSUS

The State Of Maharashtra And Others ......

Ashatai @ Ashabai Kakasaheb Kolte, Party in person ......

CORAM : SMT. VIBHA KANKANWADI AND HITEN S. VENEGAVKAR, JJ.

DATE : 19 JANUARY, 2026 PER COURT :- 1.

Not on board. Taken on board.

2.

The petitioners, by filing a praecipe, have stated that their advocate has instructed them to mention the matter. Their grievance is that their matter was mentioned on Saturday and this Court has given a date of two months, which according to them was not convenient and perhaps they wanted an earlier date.

3.

First of all, we make it very clear that, taking into consideration the pendency of approximately 15,000 cases before this Court and with the urgency that is stated, we are giving the dates. We deprecate the practice of an advocate advising clients to directly mention the matter before the Court, when the advocate has knowledge that a party appearing in person, unless he goes through the applicable rules, cannot

P1-6186-24-WP.odt {2} even address the Court. Therefore, issue show cause notice to the advocate on record as to why action should not be taken against him, which is permissible under the law.

4.

Place the matter for further consideration on 02.02.2026, high on board.

5.

We make it clear that we are listing the matter only for the limited purpose of hearing the advocate, and not for preponing the date of hearing of the matter.
