DATE: 23rd September, 2024 P.C.:- 1] The learned counsel for the petitioner submits that Original Application No. 3 of 2012 filed by respondent no.1 herein has been pending for a period of almost twelve years. Though pleadings are complete, the Original Application has not been taken for final arguments. He further submits that the petitioner herein has filed Interim Application No.320 of 2023 in the said proceedings which is also pending. He seeks expeditious consideration of that Interim Application.

2] Despite service, the respondent no.1 has not chosen to appear. Since the petitioner's Interim Application is pending before the Debts Recovery Tribunal, it is directed that the same be decided on its own merits within a period of six weeks of the next date of the proceedings. Liberty is granted to the applicant to make a request for 1/2

32-WP-6193-24.doc expeditious disposal of Original Application No.3 of 2012. If such request is made, the same shall be considered in the backdrop of the pendency of the proceedings since 2012. Keeping all points on merits open, the writ petition is disposed of.
