In view of the fact that the work order issued in favour of respondent no.2 has been executed by it and the payment has already been made by Pune Municipal Corporation to respondent no.2, the issue with regard to the validity of the Corporation in rejecting the technical bid of the petitioner has been rendered academic.

Therefore on account of efflux of time no effective relief can be granted to the Petitioner at this point of time. Accordingly, the Petition is disposed of with liberty to the Petitioner to take recourse to remedy to claim damages, if any if so advised in accordance with law. ( M. S.
