IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 6252 OF 2025 Vaishnavi Caim Sambuddha

...Petitioner

Versus

Alok Nath Sambuddha

...Respondent

WITH INTERIM APPLICATION NO. 8647 OF 2025 SANTOSH SUBHASH KULKARNI IN WRIT PETITION NO. 6252 OF 2025 SANTOSH SUBHASH KULKARNI Date: 2026.02.27 14:59:37 +0530 WITH WRIT PETITION NO. 6253 OF 2025 WITH INTERIM APPLICATION NO. 7716 OF 2025 WITH INTERIM APPLICATION NO. 8327 OF 2025 IN WRIT PETITION NO. 6253 OF 2025 None for the Petitioner.

Mr. Naveen Sharma, for the Respondent.

CORAM:

N. J. JAMADAR, J.

DATED:

25th FEBRUARY, 2026 PC:- 1.

Heard the learned Counsel for the respondent. 2.

None appears for the petitioner.

3.

By an order dated 3rd February, 2026, this Court had directed the petitioner to appear before this Court in-person on 20th February, 2026.

1/2

26-WP6252-2025.DOC 4.

On 20th February, 2026, the petitioner appeared in-person through Video Conferencing. The petitioner sought short accommodation as her Advocate was not in a position to appear before the Court.

5.

As the grievance of the respondent is that, despite the order dated 3rd September, 2025, the petitioner has removed the child to Mathura, this Court was constrained to direct the petitioner to appear in-person before the Court. 6.

Since none appears for the petitioner today, the Court would be constrained to dismiss the petitions for nonprosecution. 7.

Nonetheless, with a view to provide an opportunity to the petitioner to appear before the Court and work out the petitions, by way of indulgence, post the petitions on 10th March, 2026. [N. J. JAMADAR, J.] 2/2
