The case of the Petitioner is that a proposal submitted by Respondent- Management in favour of the Petitioner to transfer the Petitioner from unaided to aided division in the institution is not being processed. It is asserted by the Petitioner on oath in the petition that there is no order rejecting the proposal but the same is not being entertained in view of the Circular dated 1 December 2022.

We proceed on two assertions made by the Petitioner. Firstly, the Respondent- Management is supporting the Petitioner and there are no inter-se disputes. Second, the proposal is in fact submitted and is not yet decided.

A Government Circular dated 29 April 2024 has been issued bringing the methodology for processing the proposal of transfer from unaided to aided division. The Respondents will follow the methodology laid down in the Government Circular dated 29 April 2024 and take necessary steps.

Writ petition is accordingly disposed of .
