Heard Mr. Pai, learned Senior Advocate for Petitioners and Mr. Khairnar, learned Advocate for Corporation.

Considering the substantial challenge maintained by the Petitioners to the impugned identical judgments all dated 01.02.2024, the time which has been granted by the learned City Civil Court, Mumbai vide its judgment dated 01.02.2024 subject to filing of the undertaking stands extended by a further period of six weeks from today to enable the Corporation to file an appropriate affidavit-inreply to the present Writ Petitions. 3.
Mr. Pai, learned Senior Advocate on behalf of all Petitioners in the 84 matters before me would submit that undertakings have already been filed before the learned City Civil Court, Mumbai as directed in compliance.

Mr. Khairnar enters appearance on behalf of the Corporation. Corporation is directed to consider the Petitions and file appropriate affidavit-in-reply. Corporation is directed to consider the decision of this Court in the case of Vivek Gawde Vs. Municipal Corporation of Greater Mumbai & Ors1 while filing the affidavit-in-reply. (2022) 5 AIR BOM R 295

Mr. Pai seeks leave of the Court to file relevant / necessary pleadings and documents which are germane to the present cause of action. He desires to file the same in the form of compilation of documents. Leave is granted. The said compilation shall be placed on affidavit and filed in the Registry and copy shall be given to the Respondents.

It is seen that identical impugned judgments have been passed by the learned City Civil Court, Mumbai in all matters save and except the distinction being the title and name of the party in the said judgments. In that view of the matter, it is seen that construction of all Writ Petitions is also identical. Hence, in the meanwhile, there shall be ad-interim relief in terms of prayer clause (c) in all Writ Petitions which are listed in cause-title herein above. 7.
