The only relief as sought by the petitioner in the present proceeding is that the Sub-Divisional Officer/ Land Acquisition Officer, Panvel be directed to decide and the application/representation made by the petitioner on the apportionment of the land acquisition which are subject matter of acquisition under the Maharashtra Highways Act, 1955. 2.

As observed by the coordinate bench of this Court in its order dated 6 May 2024, there is a dispute in regard to the apportionment between the petitioner and respondent Nos.1 to 6, which pending consideration of respondent No.7 - Sub-Divisional Officer, Panvel. It is informed to us that the parties are also in the process of arriving at a settlement. Pallavi Wargaonkar, PS

Be that as it may, if there is any settlement, the parties are free to place such settlement before the Sub-Divisional Officer, Panvel. In the event, there is no settlement, the application/representation as made by the petitioner to the Sub-Divisional Officer - respondent No.7 on apportionment is required to be decided in accordance with law. 4.

Let the same be decided by the Sub-Divisional Officer, Panvel - respondent No.7 within a period of four weeks from the date on which copy of this order is presented to him.

All contentions of the parties are expressly kept open. 6.
