CORAM

: RAVINDRA V. GHUGE & Y. G. KHOBRAGADE, JJ.

DATE : 3rd July, 2024 ORDER:

1.

The learned Advocate for the Petitioners submits that during the pendency of this Petition, some amounts towards the outstanding bills of the Petitioners payable under the contracts, have been paid. It appears that some amounts have not been paid since the Respondents are raising a dispute.

2.

As such, unless the amounts are admitted, we cannot entertain a Writ Petition in the face of a dispute with regard to the works done and the amount in the bills, of a private contractor. 3.

The learned Advocate for the Petitioners submits on instructions that the Petitioners would prefer a Civil Suit for recovery of the amount.

910wp6572-24 4.

In view of the above, this Writ Petition is disposed off. 5.

The disposal of this Petition would not be an impediment for the Petitioners to file recovery suit, subject to the law of limitation. ( Y. G. KHOBRAGADE, J. ) ( RAVINDRA V. GHUGE, J. ) JPChavan
