Prima facie it appears that the property was initially owned by predecessor of the parties to the proceeding. Therefore, the parties to the proceeding appear to be co-owner of the property. Hence, in absence of conferment of exclusive ownership on the applicant, the application under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 was not maintainable. Hence, issue notice to the respondents, returnable on 24 June 2024.

Till 24 June 2024, there shall be ad-interim relief in terms of prayer clause (b).
