Prima facie, Form-32 has placed on record, it indicates that the petitioner is non-executive director and an order under Section 7A of the Employees' Provident Funds and Miscellaneous Provisions Act, 1952 has been passed against the company. Prima faice recovery cannot be made against the non-executive director. Hence, till the next date, there shall be ad-interim relief in terms of prayer clause (d) qua petitioner only.
