Prima facie it appears that the property in dispute was owned by the father and the mother of the petitioner. The father of the petitioner died. Therefore, his rights in absence of Will shall devolve on the petitioner along with mother. Therefore, the petitioner's status would be that of co-owner. Hence, prima facie proceedings under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 is not be maintainable. Hence, issue notice to the respondents, returnable on 24 June 2024.

Till 24 June 2024, there shall be ad-interim relief in terms of prayer clause (c).
