In view of the opinion by the learned Division Bench of this Court at Aurangabad Bench in the case of Jagdish Pitamber Pawar Vs. Pitamber Pundlik Pawar and Others passed in Writ Petition No.36 of 2023 by order dated 29.11.2023, an Appeal under Section 16 (2) of the Maintenance and Welfare of Parents And Senior Citizens Act, 2007 would be maintainable at the behest of the petitioner, considering which the petitioner is relegated to the appellate remedy. The appeal shall be filed within a period of one week from today.
