Prima facie, it appears that the show-cause notice did not contain specific violation allegedly committed by the petitioners as required under Section 75(5) of the Maharashtra Cooperative Societies Act, 1960. Moreover, it has to be considered as to whether the order under Section 75(5) can be passed simultaneously with exercising of power under Section 77A of the Maharashtra Cooperative Societies Act, 1960. Hence, till the next date, there shall be ad-interim relief in terms of prayer clause (c). 2.

Stand over to 18 June 2024.
