Heard the learned Advocate for the Petitioner. 2.

After hearing for some time, it transpires that the order which is under challenge has been passed in a Miscellaneous Civil Application for condonation of delay, which has been rejected by the first Appellate Court. Rejection of the application for condonation of delay amounts to rejection of the first appeal and, therefore, the learned Advocate prays for withdrawal of the present petition to avail appropriate remedies as available in law.

The Writ Petition is dismissed as withdrawn with liberty to initiate appropriate proceedings in accordance with law. 4.

While deciding the proceedings that may be filed by the Petitioner, the delay consumed during the pendency of this writ petition shall be taken into consideration, and the application shall be decided on its own merits.
