The Petitioners claim to be the tenants over the land which has been acquired for construction of a new railway line Solapur - Tuljapur - Dharashiv. Their names do not appear in the award, dated 12.01.2024. They contend that the competent authority has still not disbursed the award amount to the original landlord, Respondent No.4 herein.

Issue notice to the Respondents, returnable on 06.08.2024. The learned AGP waives service of notice on behalf of Respondent Nos. 1 to 3.

If the amount of compensation is not disbursed by Respondent No.3 to Respondent No.4, or if the amount is being disbursed, in the interregnum, Respondent No.3 shall take an affidavit undertaking from Respondent No.4, that the amount so disbursed to Respondent No.4, shall be returned to the extent of the share of the Petitioners, if it is finally concluded that the Petitioners have some share in the compensation amount. Such affidavit undertaking should be tendered urgently.
