ORDER :- 1.

Heard Mr. Abhijit More, learned counsel for the petitioners. He invites attention of this court to the order passed under Section 88 of the Maharashtra Cooperative Societies Act by which petitioners were exonerated from the charge. However, in appeal filed by the Chairman of the bank, without notice to the petitioner, the Divisional Joint registrar passed an adverse order dated 12th October, 2022. Apparently, petitioners were not made party in Appeal No. 55 of 2023 and orders prejudicial to their interest is passed.

Considering the submissions, issue notice to respondents returnable on 22nd August, 2024.

Learned AGP waives notice for respondent Nos. 1 and 2. 4.

Apart from court notice, petitioner shall be at liberty to

{2} 920 sr.no..odt service No.4 by any other alternate mode as permissible in law and file affidavit of service before the returnable date. 5.

Till then, there shall be interim relief in terms of (C) to the extent of the petitioners only.
