On the last occasion since the learned advocate for the petitioner was absent and matter was fixed for today for dismissal. However, today again the learned advocate for the petitioner seeks adjournment. Adjournment is refused.

Learned advocate for the petitioner states that his appearance was not shown on the last occasion. However, since the matter is fixed today under the caption "for dismissal", it was expected from the advocate to prepare himself. 3.

By the impugned order, the Divisional Joint Registrar, Mumbai has set aside the order passed by the Deputy Registrar exercising power under section 75(5) read with section 77(a) of

1-wp7351-2024.doc the Maharashtra Cooperative Societies Act, 1960. 4.

The finding recorded in the impugned order indicates that the objections as required under section 77(a) of the Maharashtra Cooperative Societies Act, 1960 were not invited before passing such order. Moreover, the order under sections 75(5) and 77(a) of the Maharashtra Cooperative Societies Act, 1960 was passed by the common order.

Considering the reasons assigned in the impugned order, no reason to interfere in the impugned order. The writ petition is dismissed.
