...Petitioner

Versus

State of Maharashtra And Ors.

...Respondents

__________ Mr. V.S. Tadake, for the Petitioner.

Ms. S.S. Bhende, AGP for the Respondent - State. Mr. Meet Sawant i/b. K.P. Law Associates LLP for Respondent Nos.2 to 6. __________ CORAM :

G. S. KULKARNI & ADVAIT M. SETHNA, JJ.

DATE :

19 MARCH 2025 P.C.:

1.

We have heard learned counsel for the petitioner. This petition under Article 226 of the Constitution of India is filed praying for the following reliefs:- "(a) This Petition may be allowed and the Respondents may be directed to make payment of the all arrears of the bills issued by the petitioner immediately along with appropriate rate of interest on the said bill amounts."

2.

The prayer in the petition is simplicitor for a money claim. We are of the clear opinion considering the settled principles of law that such a relief in a writ petition cannot be granted. Be that as it may, it appears to be the case of the petitioner that the petitioner has completed the contractual work and is entitled to payment. His representation in that regard and/or bills are pending consideration. Pallavi Wargaonkar, PS

Let respondent nos.2 to 6 to take an appropriate decision on the representation as made by the petitioner in accordance with law and inform the decision to the petitioner within a period of four weeks from today.

4.

All contentions of the parties in this regard are expressly kept open to be agitated in aforesaid proceedings. Petition is disposed of in the abovesaid terms. No costs.
