By our previous orders, we had noted several issues of grave concern with regard to public health and pollution as raised in this Petition, which would not only affect the residents of the Badlapur Kulgaon Municipal Council but also affect the population of the region in general since the issue pertains to open pollution being caused by the building constructed by the Respondent No.5.

Today there are two reports which are placed for consideration, one is a report of the expert appointed by this court namely M/s G. M. Arch Pvt Ltd. and the other is a report of the Collector.

2/2 12-wp-7404-24.doc Let both the reports be considered by the parties and in so far as those issues which are required to be immediately attended, looking at the exhaustive report which is filed by the expert appointed by the Court on the current situation with regard to the Water contamination, Eutrophication, Habitat degradation, Health risks, Health implications, Environmental impact and the several problems of contamination of soil, Groundwater contamination, Crop contamination and the immediate solutions which are required to be resorted and the long term solutions are required to be considered and taken into consideration. We would intend to hear the parties on these reports and the issues which are raised therein.

Stand over to 14th August 2025.

In the meantime, Mr. Adsule can also consider the reports and if time permits, he can also do a visit all the area so that the realistic submissions can be made before the Court.
