The petitioner impugns order dated 06.06.2024 passed by Divisional Joint Registrar, Co-operative Society, Nashik Division in Revision Application No.74/2024.

The petitioner moved proceeding seeking disqualification of respondent no.6 as Director of Ahmednagar District Central Cooperative Bank (ADCC Bank) for year 2020-21 to 2025-26. According to petitioner, Special Auditor conducted enquiry as to affairs of respondent no.2 and found that petitioner suffered disqualification to contest election of respondent no.4-Society under

(2) Section 73(C)(A)(3)(A)(1) of Maharashtra Co-operative Societies Act (for short 'MCS Act').

The Divisional Joint Registrar, Co-operative Society, Nashik Division rejected petitioner's Revision filed under Section 154 of MCS Act holding that petitioner has no locus standi to raise issue as to disqualification of respondent no.6. Reference is given to observations of this Court in case of Janabai w/o Gondu Mahajan Vs. District Co-operative Election Authority and the Divisional Joint Registrar, Co-operative Societies Nashik Division, Nashik1, wherein this Court held that person, who is neither member or voter of Society cannot raise objection as to disqualification of Director.

The learned Advocate appearing for petitioner endeavours to contend that petitioner was infact member of Rumbhodi VKSS Society, who is member of Ahmednagar District Central Cooperative Bank and, therefore, petitioner would get locus to raise challenge regarding disqualification of Directors. However, aforesaid contention was neither pleaded in application or in present Writ Petition. Even otherwise, petitioner could not demonstrate from record his locus standi to raise challenge or objection as to disqualification of respondent no.6. 2023 (3) Mh.LJ 386.

In that view of matter, this Court do not find any reason to entertain Writ Petition. Writ Petition stands dismissed. 6.

In view of dismissal of Writ Petition, pending Civil Application also stands disposed of.
