The Petitioners in these Petitions pray that the proposal seeking approval to their appointments, purportedly pending with Respondent No. 2 Education Officer Secondary, Zilla Parishad, Kolhapur, be decided within a time frame. Both claim to be working as Shikshan Sevak and Peon respectively.

The learned AGP is under written instructions from the Zilla Parishad that neither the Management has tendered any such proposal, nor does the inward register of the Zilla Parishad indicate an entry of the submission of such proposal.

It is well settled that this Court cannot exercise its Writ jurisdiction for considering such disputed aspects. Therefore, either the Management can tender a fresh proposal or may take recourse to a remedy as my be permissible in law for proving that the proposals were tendered and that the Zilla Parishad is not making a truthful statement. 4.
The learned Advocate for the Petitioners submits that the Management may be directed to file a fresh proposal. 5.
In view of the above, both these Writ Petitions are disposed off. Let the Management tender a fresh proposal to Respondent No. 2. Needless to state that Respondent No. 2 shall follow the due procedure laid down in law and after conducting a meticulous verification exercise, including of the eligibility of the Petitioners and the publication of the advertisement, a decision on the proposals may be arrived at within a period of 60 days from the date of submission of the proposal.
