This petition is filed under Article 226 of the Constitution of India. The limited relief that the petitioners are seeking is a decision on the representation of the petitioners dated 27 November 2017, addressed by the petitioners to the Stamp Duty Officer, Thane. The petitioners by such representation is seeking adjudication of stamp duty on a registered deed of conveyance executed by the petitioners pertaining to two industrial galas situated at Mouje Narpoli, bearing Municipal No.18, ground floor, Dhamankar Naka, Patel Compound, Bhiwandi, Thane. It is in the above backdrop, we have heard learned counsel for he parties. Although there is no written opposition or reply filed on behalf of the respondents, no Mayur Adane, PA

302-WP-7996-2024 (C).doc prejudice would be caused to them, considering the nature of the order that we propose to pass in these proceedings. 2.

From the record, it appears that, the representation made by the petitioners to the Stamp Duty Officer, Thane dated 27 November 2017 is pending, which the respondents may decide, if not so decided until date. 3.

In our view, the following order would serve the interest of justice.

ORDER

(i) The competent authority of the respondent is directed to decide the representation of the petitioners dated 27 November 2017, by passing a reasoned order and in accordance with law, as expeditiously as possible, in any event within a period of four weeks from the date of this order is presented to the said respondent by the petitioner. (ii) All rights and contentions of the parties are expressly kept open.

(iii) Writ Petition is disposed of in the above terms. (iv) Disposed of. No costs.
