According to the petitioners, the respondents have failed to plead due diligence as required under proviso to Order 6 Rule 17 of the Civil Procedure Code, 1908. Hence, Issue notice to the respondents, returnable on 8 August 2024.

Considering the reason of inadvertence assigned in the application for amendment of written statement explaining due diligence, there shall be ad-interim relief in terms of prayer clause (c).
