CORAM
: AMIT BORKAR, J.
DATED : DECEMBER 5, 2025 P.C.:
1.
The petitioners are the Managing Committee members of the housing society against whom an order has been passed under Sections 75(5) and 77A of the Maharashtra Cooperative Societies Act, 1960 ("MCS Act"). The petitioners preferred a revision, in which the Revisional Authority rejected the application for stay. 2.
This Court, by order dated 6 June 2024, granted ad-interim relief of stay. The said stay continues to remain in force. Therefore, in my opinion, the appropriate course would be to direct the Revisional Authority to decide the petitioners' revision application, and in the meantime, continue the interim protection.
45-wp-8166-2024.doc 3.
Hence, I pass following order:
(i) The Revisional Authority is directed to decide Revision Application No. 87 of 2024 within eight weeks from the date of appearance of the parties.
(ii) The parties shall remain present before the Revisional Authority on 15 December 2025 at 10:30 a.m.
(iii) The ad-interim relief granted by this Court shall continue during the pendency of the revision application and, in the event the revision is decided against the petitioners, for a further period of four weeks thereafter.
4.
The writ petition stands disposed of in above terms. 5.
No costs.
